7/28/07:
  1. Clarify other uses for Interim Alternative Education Setting outside of context of disciplinary action.
  2. Include Ch 56/60 Community Work Group in development of guidelines.
  3. Recommendation to include in guidelines regarding intial evaluations: submit evaluation reports to team 5 calendar days prior to eligibility determination meeting.
  4. Clarify under Re-evaluations that IDEA only exempts students who graduation from high school with a regular high school diploma--not GED or competency-based diploma.

8/11/07:

  1. Under IEP Team members (§8-60-321), clarify the term "individuals who have knowledge or special expertise regarding the student"
  2. Regarding other methods to ensure parent participation (§8-60-322), document the parent's reasons for non-attendance and parent's conditions for attendance at an IEP meeting, when this information is made available to the Department.
  3. Under when IEPs must be in effect, §8-60-323(b)(i), explain the State policy that is referenced and where it was developed.
  4. In §8-60-502, explain the "agency criteria" which must be met in order for an independent educational evaluation to be considered by the Department; cite the criteria for "qualified examiner"
  5. Under §8-60-510, clarify who has decison making authority for DOE in a settlement agreement. Is it permissable for the complex area superintendent sign off of (or rescind) the agreement even though the CAS was not at the resolution session?
